7:01 am
of joy when the class president stunned them all. it's an inspirational moment you'll just want to see. i wanted to pop out of my seat after i saw that. >> i got chills. you'll see the graduation. >> good morning, america. so much to get to, including the first lady unplugged. michelle obama went head to head with a heckler at a washington fund-raiser last night, basically said it's you or me. we have the audiotape coming right up. >> she did not back down one iota. and let's get right to the big breaking story from espn's "outside the lines." major league baseball players including huge stars like a-rod, alex rodriguez, may face significant suspensions in a massive doping scandal and, josh, i know you've been following this all overnight. >> for months, in fact. it looks like a stunning end is
7:02 am
near in this wide-ranging investigation into the alleged performance-enhancing drug use still in major league baseball. again, it does appear a stunning end to this probe is near. espn's "outside the lines" reports this morning that dozens of major league baseball players including the yankees' $29 million a year third baseman alex rodriguez may soon be suspended allegedly for doping and then lying to baseball about it. espn says the possible suspensions are based on testimony and notes from this man, tony bosch, who ran an anti-aging clinic in miami called biogenesis. but when that business folded late last year medical records from the clinic were leaked, records which allegedly showed doping by as many as 30 high-profile ballplayers. >> what baseball didn't have was somebody who could swear to the truth of those documents and that's what they have now with tony bosch. he'll testify to say those documents are true and accurate. >> reporter: allegedly on those records, rodriguez as well as the blue jays' melky cabrera,
7:03 am
rangers' nelson cruz and ryan braun of the milwaukee brewers, who allegedly failed a steroid test in 2011 but later appealed the suspension and won. >> if i ever made mistakes in my life, i've taken responsibility for my actions and truly believe truly in my heart and i would bet my life that this substance never entered my body at any point. >> reporter: bosch originally refused to cooperate but had a change of heart after the league sued him. he says he provided ballplayers with banned drugs and that he even injected them into rodriguez himself. >> by cooperating with baseball he's trying to take some pressure off of his life financially and legally so in return, baseball will drop the lawsuit. they'll indemnify him for any civil liability he has for testifying against the players. >> reporter: sources tell espn this morning that the league may try to suspend some players for up to 100 games instead of the standard 50-game ban because the players allegedly broke two rules, doping and then lying about it.
7:04 am
now, we cannot testify to bosch's credibility on this matter and we can also tell you ryan braun always said that he had contact with tony bosch but bosch served as a consultant to him while fighting that suspension back in 2012. certainly not the end of it. boy, 100-game suspensions would be an entirely new precedent for the sport. >> it'll rock the season. josh, thanks very much. the latest on the severe weather hitting so much of the country. flood warnings across the midwest with towns on the mississippi dealing with breached levees and sam here with more on that, and that topical system brewing in the gulf. >> the tropics first, george. this is the pending situation. the one that we'll watch for development very quickly. we've got about a 40% chance from the hurricane system. join me at the wall. this is it. the pulsating circle of concern showing you where those clouds are. there are a couple things i want to point out when we look at this system, not developed into tropical strength of a storm and probably as they said, 40% chance. having a problem with this dry air. if you cut this in half and
7:05 am
notice how dry this flow is coming from the west that's the problem. as it moves a bit more to the northeast in any form it will likely get better organized. the hope here is it doesn't organize too much and picks up speed. but either way it's about 3 to 10-feet waves up against the west coast of florida. also 8 inches of rain possible from tampa all the way to jacksonville and the bull's-eye zone, 4 to 6 easily but as it continues the track this could be a lot heavier rain. when it gets to the eastern seaboard it will probably mix with a secondary low and that means this friday into saturday it's going to be raining for the northeast. if this forecast is accurate and, again, it means a lot as to whether or not there will be developing here. anything could change the path of this. this is why we're watching it carefully. as we said at the top of the show, still this area of right now flooding going on from past rain, 20 inches in this area and steve osunsami is there, high, high water and levee problems. good morning, steve. >> reporter: good morning, sam. the mississippi is just a few miles this way now and this is
7:06 am
the missouri, both rivers are flooding. there are farmlands flooded. homes that are flooded. there are streets that are impassable. this is a beauty shop underwater. the water is receding but that heavy bulge of rain is now moving downstream. authorities here are worried about two things, one, there's the chance of more rain, which doesn't help the situation here. also, they're worried about two levees, one of them breached yesterday and there's a chance that another could breach today. if that happens they'll be forced to evacuate even more families from their homes. sam? >> and, steve, more heavy rain from oklahoma to wichita to omaha all in that area. we'll talk more about that in the next half hour. robin? >> all right there, sam, thank you. now to what could be one of the most significant car recalls since the ford pinto, and a major alert for everyone on the roads. the u.s. government says millions of jeeps are at risk of catching on fire in rear-end crashes. the recall is based on what government experts say is a deadly fire hazard that has left an estimated 51 people dead. abc's lisa stark joins us now
7:07 am
from washington with the latest. good morning, lisa. >> reporter: good morning, robin. well, this morning chrysler is refusing to recall those vehicles. nearly 3 million of them to add some extra protection around the fuel tank which sits near the rear of the vehicle. it's a recall that could cost chrysler hundreds of millions of dollars. at least 51 people have died in fiery crashes involving the older model jeeps according to the government. it says the problem is the fuel tank sits behind the rear axle and slightly below the bumper, vulnerable to puncture. the government says in its initial findings that the defects present an unreasonable risk because people have burned to death in rear impact crashes. a recall would involve 2.7 million older model jeep grand cherokees and jeep liberties. these crash tests done by engineering students show the danger, simulated fuel spilling from the grand cherokee.
7:08 am
chrysler claims the tests were too severe. but the government points to accidents like this one on a virginia highway last october when a tractor-trailer slammed into the back of a jeep grand cherokee stopped in traffic. the jeep smashed into the car carrying harry hamilton and his daughter. hamilton was able to rescue an 18-year-old from the burning jeep but not two others. the fire spread too quickly. >> and then it just roared. it all happened in probably 20, 25 seconds. >> reporter: this morning chrysler insists that the vehicles are safe and are not defective and no recall is necessary. >> the bottom line is dollars. this recall will cost chrysler $300 million but that's a small price to pay to save the lives of kids dying in fire crashes in jeeps. >> reporter: now, chrysler is also insisting this morning that the government's analysis which has been going on for nearly
7:09 am
three years is incomplete and it says that the cars are safe and they meet all government standards. if chrysler refuses to budge, well, then the government may have to sue to force this recall. george, back to you. >> real confrontation. thanks so much. more breaking news coming in right now. want to go to abc's jon karl, our chief white house correspondent. we're just learning now that the president's national security adviser tom donilon will be replaced by u.n. ambassador susan rice, of course, in the middle of that -- all that controversy over benghazi. >> reporter: that's right, george. just a few minutes ago a senior white house official told me that donilon is out and susan rice is in. this will be something that will certainly capture the attention of republicans. susan rice, of course, as you mentioned was the one that went on the sunday shows right after the attack in benghazi and talked about it being something that came out of protests in cairo, very controversial set of sunday show appearances.
7:10 am
she is somebody that republicans don't like very much. now close to the president and she will be his national security adviser. >> she's been with him right from the start from the beginning of his presidential campaign. the president looked at her for a possible pick as secretary of state and she will be a hard-nose national security adviser. >> reporter: she is a no-nonsense adviser. as you mentioned one of the very first foreign policy advisers on the president's campaign, close to him even before he officially launched the campaign. she is tough. she is no nonsense and, frankly, she was early indications the person the president wanted to put over as secretary of state. republicans made it clear they would do everything they could to block that. as national security adviser she does not need senate confirmation, the president is free to choose whoever he wants. >> and speaking of no nonsense, jon, michelle obama, private fund-raiser at a home in washington, d.c. confronted by a gay rights activist and she was having none of it. >> one of the things -- one of the things that i don't do well is this.
7:11 am
do you understand? >> jon, right after that she walked right up to the heckler and went toe to toe. >> reporter: this is something else, george. the heckler told us afterwards that she felt like the first lady was just a few inches away from her face. what happened is she came down from the podium approached the heckler and said, you could hear a little in the tape, "one of the things i don't do well is this. listen to me, or you can take the mike, but i'm leaving. you all decide. you have one choice." george, the crowd loved it. they started applauding. the heckler was removed and the first lady went on with her speech. >> round one to the first lady. jon karl, thanks very much. we're going to stay in washington for the latest on the sexual assault crisis in the military. thousands of cases every year and the nation's top military leaders have lined up before congress to answer a lot of questions. abc's martha raddatz joins us from washington with the latest on all this. good morning, martha. >> reporter: good morning, robin. the military chiefs all took responsibility for failures and

promised this crisis would have their full attention, but the senators wanted more. there was palpable frustration and impatience. >> how many women and men are being raped and sexually assaulted? are you frickin' kidding me. why is one in ten going to trial and why is only one in ten cases result in convictions? >> reporter: a question that vexes the most senior officers, all of them men. >> we're failing in our efforts to fully protect our people from sexual assault and sexual harassment. >> sexual assault is criminal behavior that has no place in the united states marine corps. >> reporter: but the military leaders are all resisting efforts to have victims of abuse report to special military legal authorities, instead of commanding officers. >> i believe it is essential our commanders be involved in each phase of the military justice process. >> reporter: the problem of sexual assault has only gotten worse.
7:13 am
an estimated 26,000 sexual assaults last year, up 35%, and in just the past few weeks the head of a sexual assault response office charged with sexual battery. a soldier accused of secretly videotaping female cadets in the showers. three naval academy football players accused of rape. >> you have lost the trust of the men and women who rely on you. they're afraid to report. >> reporter: and for veteran and sexual assault survivor anna bhagwati, those words rang true. >> women and men must put up with all kinds of degrading behavior, not random acts but routine rites of passage still condoned by senior enlisted and officer leaders. >> reporter: military and civilian leaders have been promising to fix the problem for decades. asked by one senator why he should believe this time will be different the chairman of the joint chiefs said in prior years leaders focused on victim protection rather than prevention. robin and george.
7:14 am
>> they are taking the blame this time. it was something to see all those military leaders facing congress. >> yes. let's get to the other top stories that are developing with josh. good morning to all of you. we'll begin with developments overnight putting more pressure now on the u.s. to intervene in syria's civil war. the british have now joined the french saying there is evidence the nerve gas sarin has been used. france says there's no doubt the syrian regime used it and now we're just getting word this morning that syrian forces have captured a key border city. more news as it becomes available. meanwhile, a judge has accepted the insanity plea of james holmes, the man accused of gunning down 12 people in a colorado movie theater. now holmes will undergo a mental evaluation. the plea could spare him the death penalty. and apple has suffered a major defeat in the smartphone wars losing a legal battle against samsung, the international trade commission has banned u.s. sales of the iphone 4, the ipad 2 and other older models after ruling that apple infringed on samsung's
